BY ACCESSING OR USING THE SERVICE YOU AGREE TO BE INDIVIDUALLY BOUND BY THESE TERMS.

BY ACCEPTING THIS AGREEMENT, YOU AGREE TO RESOLVE DISPUTES IN BINDING, INDIVIDUAL ARBITRATION AND GIVE UP THE RIGHT TO GO TO COURT INDIVIDUALLY OR AS PART OF A CLASS ACTION. IF YOU DISAGREE WITH ANY PART OF THE TERMS THEN YOU MAY NOT ACCESS THE SERVICE. THIS TERMS WILL AFFECT YOUR LEGAL RIGHTS. REVIEW THEM CAREFULLY

WELCOME TO CHANGE PERSPECTIVE YOGA, LLC (“CHANGE PERSPECTIVE YOGA, LLC”, “us”, “our” or “we”) and in conjunction with the documents referred to on it, provides you with the terms of use on which you may make use of our website, app, content, videos, training materials, products, services and or other materials ( collectively along with our titles, features, content, software, update, audio content, videos files, downloadable content, add-ons, and/or modified versions “content”), with the following link which includes without limitations : https://changeperspectiveyoga.uscreen.io/

Adhering to and following these Terms and Conditions are required for visiting, browsing and using the Website. All visitors, users, customers and others who desire to visit, enter, browse or use the Website are bound by these Terms and Conditions. Users of the Website shall be referred to as "users," "you," "your," and other similar words. If you are visiting, browsing and/or using the Website on behalf of an organization, company or firm these Terms and Conditions apply to the organization, company or firm, and you and the organization, company or firm warrant that you and the organization, company or firm have complete power to approve and enter into these Terms and Conditions, and your affirmation of these Terms and Conditions binds the organization, company or firm.

Please read these terms and conditions (hereinafter referred to as the “Terms and Conditions” or “Agreement”) carefully before using the Website & app. By using our Website & App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You do not have authorization to use the Website and App if you dispute with any element of the Terms and Conditions. If you do not agree with our Terms and Conditions, please do not use our Website and App.

By signing up and attending a class, workshop, or training with Change Perspective Yoga, LLC, Mathieu Boldron or any teacher on this Website & App , you also agree to the following terms and conditions:

ABILITY TO ACCEPT TERMS OF SERVICE:

You affirm that you are at least eighteen years of age and are able and competent to enter into this agreement and condition set forth. Individuals under the age of 18, or applicable age of majority, may utilize the service only with the involvement of a parent or legal guardian, under such person's account and otherwise subject to these Terms of Use.

PHYSICAL CONDITION:

You are responsible for ensuring that your health and body are capable of participating. Please consult with a healthcare practitioner before performing any type of exercise. By signing up to any class, workshop or training with Change Perspective Yoga, LLC, Mathieu Boldron and/or any teacher on this website & App, you are agreeing to take sole responsibility for your safety and well-being and acknowledge that Change Perspective Yoga, LLC, Mathieu Boldron and/or any teacher on this website & App, is not responsible for any injuries that may occur.

MEMBERSHIP, FREE TRIALS, COUPON, CANCELLATION AND REFUNDS:

1. Membership

Ongoing Membership. Your Change Perspective Yoga membership, which may start with a free trial, will continue month-to-month or year-to-year, based on your membership type and automatically renew unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews each month or each year in order to avoid billing of the next months or next years membership fees to your Payment Method. You must have Internet access and provide us with a current, valid, accepted method of payment (as such may be updated from time to time, "Payment Method") to use the Change Perspective service. We will bill the monthly or yearly membership fee to your Payment Method.

2. Free Trials

Free trials are for new members only. Change Perspective Yoga, LLC reserves the right, in its absolute discretion, to determine your free trial eligibility. We will begin billing your Payment Method for monthly or yearly membership fees at the end of the free trial period of your membership. Your membership will automatically renew monthly or yearly at the start of each billing period unless you cancel prior to the end of the free trial period. If you are in need of any support, reach out by emailing: mathieuboldron@gmail.com or changeperspectiveyoga@gmail.com We may authorize your Payment Method through various methods.

3. Coupon code:

If the Change Perspective Yoga service or product (monthly or annual membership) purchased costs less than the value of the coupon, purchaser is not entitled to money back nor an account credit for the difference of subscription and coupon value.

4. Cancellation

You may cancel your Change Perspective Yoga membership at any time, and you will continue to have access to the Change Perspective service through the end of your monthly or yearly billing period. We do not retroact payment. We do not provide refunds or credits for partial-year or partial-month periods nor unwatched change perspective yoga video content or services.

5. Refunds

All payments will be processed through Stripe and/or PayPal. Payments for memberships, programs, classes, workshops are non-refundable. Payments for trainings are non-refundable, but may be transferable to a later date of the same training. Please contact mathieuboldron@gmail.com if a critical, unexpected life situation arises.

TERM OF USE AND LICENSE:

Change Perspective Yoga, LLC grants to you a personal, nonexclusive, nontransferable, non-sublicensable, revocable, limited right and license to download, listen to, play, display, and use the Content solely for your permitted use within the Services (collectively, the “License”). “Content” means the audio and/or video recordings, text, scripts, descriptions, software, graphics, photos, sounds, music, videos, audiovisual combinations, communications, works of authorship of any kind, interactive features, or other materials that are generated, provided, or otherwise made available through the Services.

The rights granted to you under the License are subject to these Terms and your full compliance with the Terms, and you may only make use of the License if you comply with all applicable Terms.

The Content is not sold to you but licensed to you, and you hereby acknowledge that no title or ownership in the Content is being transferred or assigned to you and the Terms should not be construed as a sale of any rights in the Content.

Change Perspective Yoga, LLC retains all right, title, and interest to the Content, including, but not limited

to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, audio files, MP3 files, video files, audiovisual files, themes, characters, character names, stories, dialog, settings, artwork, sounds effects, musical works, and moral rights. Change Perspective Yoga, LLC has the

right to remove some or all of the Content from the Sites or Apps at any time for any reason.

CHANGE PERSPECTIVE YOGA, LLC’s unique trademarks or service marks apply to any publications, goods, information, and services mentioned herein or on the Website, APPs. Other business and product names featured on the Website may be trademarks of their respective owners.

The Content may not be copied, reproduced, altered, modified, or distributed in any manner or medium, in whole or in part, without prior written consent from Change Perspective Yoga, LLC

All rights not expressly granted under this Agreement are reserved by Change Perspective Yog, LLC.

LIABILITY:

Change Perspective Yoga, LLC will not be liable for any direct, indirect or consequential loss or damage arising under this disclaimer or in connection with this Website and App.
Privacy policy and Terms of use may occasionally be revised and altered accordingly. Please check this page regularly for any updates.

INDEMNIFICATION AND LIMITATION OF LIABILITY:

You agree to indemnify and hold us harmless, as well as our teachers, directors, officers, affiliates, agents, successors, assigns, and any third party information providers from and against any and all losses, liabilities, deficiencies, costs, damages, and expenses (including, without limitation, reasonable attorney’s fees, charges, and disbursements) incurred by us as a result of any inaccuracy or breach of the representations, warranties, and guarantees.

Everything on the Website is provided on an “as is” basis. To the maximum extent permitted by law, we are not responsible for how you use our Website across the internet on your device. It is important to emphasise that we will act to the best of its capability, capacity and knowledge to perform our responsibilities under these Terms and Conditions as best as reasonably possible by us, but we cannot be liable for any injury, harm, loss, loss of revenue/profits, damage or anything else that occurs while you are visiting, browsing or using the Website.

By signing up to any class, workshop or training with us in video through the website or through the App, you are agreeing to take sole responsibility for your safety and well-being and acknowledge that we are not responsible for any injuries that may occur. You also understand and agree the Content, videos and accompanying materials necessarily require physical exercise or activity. By voluntarily participating in this fitness program you assume all risk of injury. Without limiting the generality of the foregoing, you understand and acknowledge that there are risks of physical injury, or even death, associated with any physical activity, including the Yoga teacher training programs with Mathieu Boldron and other teachers on the Change Perspective Yoga App and Sites and that, in addition, certain medical conditions may be aggravated or made worse by physical activity (collectively, “Risks”). You assume any and all risk and danger incidental to the use of the videos and any other materials offered by Change Perspective Yoga, LLC, including but not limited to, the foregoing Risks and the way you perceive and utilize the information conveyed in the Change Perspective Yoga videos.

FORBIDDEN ACTIVITY:

You agree not to:

(i) take any action which enforces or may enforce (as decided by us in our absolute discretion) an unfair or mass burden on our (or our third-party providers') facilities;

(ii) intrude or try to influence the healthy operation of the Website or any actions performed on the Website;
(iii) skip, evade, or try to override or sidestep any methods we might use to avert access to the Website;
(iv) use human or automatic programs, methods, or other techniques to "crawl" or "spider" any part of the Website; (v) use any kind of auto-responder or "spam" on the Website;
(vi) collect or steal any Content from the Website; or
(vii) violate our rules and regulations in any other way.

NO AGENCY:

Nothing in this Agreement shall establish or be construed to constitute any joint venture, agency, or partnership arrangement between us and you. You shall not represent yourself as having any such relationship with us.

GOVERNING LAWS AND JURISDICTION:

These Terms and Conditions are governed by the federal laws of the United States of America (USA) and the state laws of the State of MICHIGAN, and the participants consent to the exclusive jurisdiction of the courts of the State of MICHIGAN. Using the Website in areas where the Website is unlawful is strictly forbidden and you should comply with all local laws when using the Website outside of the USA.

ENTIRE AGREEMENT:

This Agreement constitutes the whole agreement between the Parties concerning the subject matter.

SEVERABILITY:

If any of the provisions in this Agreement are found to be illegal, invalid or unenforceable, the rest of the Agreement survives and continues to be valid, if necessary.

GENERAL PROVISIONS:

The Provider has the right to make changes to these Terms and Conditions at any time. The most recent version of these Terms and Conditions will be posted online on the Website. By continuing to visit, use and/or browse our website subsequent to any changes, modifications and adjustments made, you provide for consent for those changes, modifications and adjustments.

We reserve the right to refuse to provide the Website, App to anybody or any organization for any cause. In our absolute discretion, we may modify the eligibility requirements at any moment. You are completely responsible for making sure that your use of the Website complies with all relevant laws, rules, and regulations.

Our inability to assert or execute our rights, or to provide any forbearance, delay, or indulgence, shall not be interpreted as a waiver of such rights under this Agreement or otherwise.

You may print and retain a copy of these Terms and Conditions for your records.

NO WAIVER:

Our failing to uphold any element of these Terms and Conditions does not renounce our power to enforce that or any other provision of these Terms and Conditions at any time in the future. We will not waive compliance in the future just because we have waived compliance in the past. We must give you written communication of any waiver of conformity with these Terms and Conditions via one of our approved agents in order for such waiver to be enforceable.

FORCE MAJEUR:

We will not be responsible to you if we fail to execute our duties under this Agreement due to any cause beyond our immediate control.
